Overview of the New Machinery Regulation

The new Machinery Regulation (EU 2023/1230) replaces the previous Machinery Directive 2006/42/EC and introduces updated requirements for safety, documentation, and digital security.

Unlike the former directive, the regulation applies directly in all EU Member States without national transposition. The purpose is to strengthen harmonization, address technological development, and clarify responsibilities for manufacturers, importers, and distributors.

The regulation reflects the increasing integration of digital systems, software, and connected components in modern machinery.

Safety and Documentation Requirements

The Machinery Regulation requires manufacturers to:
• Perform and document a structured risk assessment
• Prepare comprehensive technical documentation
• Ensure traceability of safety-related components
• Provide clear instructions and safety information

Technical documentation must demonstrate compliance with applicable harmonized standards and regulatory requirements. It must also be retained and made available to authorities when required.

Digital documentation is explicitly recognized, reflecting modern industrial practices.

Transition to the New Regulation

The Machinery Regulation (EU 2023/1230) entered into force in 2023 and will apply from 20 January 2027.

Until then, the Machinery Directive 2006/42/EC remains applicable.

Companies should already begin reviewing:

• Existing product portfolios
• Documentation structures
• Risk assessment methodologies
• Cybersecurity integration

Early preparation reduces compliance risk and ensures a smoother transition.

What It Means for Manufacturers and Machinery

The new regulation places greater emphasis on:

• Risk assessment throughout the machine lifecycle
• Clear allocation of responsibilities within the supply chain
• Updated requirements for high-risk machinery
• Digital documentation and technical files

Manufacturers must ensure that machinery placed on the EU market complies with the essential health and safety requirements defined in the regulation.

This includes evaluating both mechanical and digital risks, particularly when machinery includes software, AI-based systems, or remote connectivity.

Focus on Cybersecurity and New Technical Requirements

One of the most significant updates in EU 2023/1230 is the stronger focus on cybersecurity.

Manufacturers must consider protection against unauthorized access, manipulation, and risks related to connected control systems.

Where machinery includes software or network communication, risk assessment must also address:

• Cyber threats
• Data integrity
• Remote access vulnerabilities
• Interaction between IT and OT environments

Cybersecurity is no longer treated solely as an IT matter, but as an integral part of machinery safety.
